Article 1 — Purpose
These General Terms and Conditions of Sale (CGV) govern the sale of products made on the website kyvano-shop.com, published by Marius Troccaz, sole proprietor (entrepreneur individuel) trading under the trade name Kyvano (SIREN 109 225 870), 126 Chemin les Ramades, 46150 Crayssac, France.
They apply to any order placed on the website by a consumer. Any order constitutes full and complete acceptance of these Terms and Conditions of Sale, which are available on the website at all times.
Article 2 — Products
Kyvano offers accessories for dogs and cats: beds, toys, scratching posts, collars, harnesses and leashes, bowls and feeding accessories, grooming, hygiene, transport and travel, as well as personalized products (engraving, photo, name).
The essential characteristics of each product (dimensions, materials, available sizes, contents) are presented on its product page. Photographs and illustrations are as accurate as possible; however, slight color variations may occur depending on the screen used.
Products are offered subject to availability of stock at our suppliers. If a product becomes unavailable after the order is placed, the customer is informed by email and refunded without delay for the sums paid for the product concerned.
Article 3 — Prices
Prices are shown in euros (€) for customers with delivery in France and in US dollars ($) for customers with delivery in the United States. VAT not applicable, article 293 B of the French General Tax Code (CGI) (VAT exemption scheme – franchise en base de TVA).
Delivery costs are shown before the order is confirmed. The price charged is the price displayed at the time of ordering.
For deliveries to the United States, customs duties or import taxes may be charged by the authorities of the country of delivery. Where they are not shown at the time of payment, they are borne by the customer.
Article 4 — Orders
The customer selects their products, enters their delivery and payment information, then confirms their order after checking its details and total price. A confirmation email summarizing the order is sent as soon as payment has been validated.
For personalized products, the customer is solely responsible for the information provided (text, name, phone number, photo): it is reproduced exactly as entered. The customer warrants that they hold the rights to the photos they provide.
Kyvano reserves the right to cancel an order in the event of a prior dispute with the customer, suspected fraud, or unlawful or offensive personalization content; the customer is then refunded in full.
Article 5 — Payment
Payment is made online, at the time of ordering, securely, using the payment methods offered on the website. Kyvano never has access to the customer's bank details.
Article 6 — Delivery
Products are delivered in France and the United States, to the address provided by the customer when ordering. They are shipped from the warehouses of our partner suppliers, located in France or abroad.
The applicable delivery costs are as follows:
- France: €3.99 — free delivery on orders of €50 or more;
- United States: $9.99 — free delivery on orders of $79 or more.
Estimated delivery times are shown on each product page and at checkout. Personalized products require additional production time, specified on their product page. A tracking number is sent by email as soon as the order ships; the parcel can be tracked on the “Track my order” page.
If the product is not delivered within the stated time, the customer may, after having requested Kyvano to deliver within an additional reasonable period, terminate the contract under the conditions provided for in articles L216-2 et seq. of the French Consumer Code (Code de la consommation). The customer is then refunded all sums paid.
The customer is invited to check the condition of the parcel upon receipt and to report any damaged or non-conforming product to kyvano.contact@gmail.com, preferably with photos, so that we can resolve the issue quickly.
Article 7 — Right of withdrawal
In accordance with article L221-18 of the French Consumer Code, the customer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to give any reason or pay any penalty.
To exercise this right, the customer notifies their decision by email to kyvano.contact@gmail.com before this period expires, by means of an unambiguous statement or the model withdrawal form set out in article 14.
The product must be returned no later than 14 days after notification of the withdrawal, complete, unused and in its original packaging. Return costs are borne by the customer.
Exception — personalized products: in accordance with article L221-28, 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the customer's specifications or clearly personalized (engraving, photo, name, text chosen by the customer).
Article 8 — Refunds
Kyvano refunds all sums paid, including the initial delivery costs (based on the standard delivery method), no later than 14 days from the date on which it is informed of the decision to withdraw. The refund may be withheld until the returned product has been received or until proof of its shipment has been provided. It is made using the same payment method as the one used for the order.
The customer may be held liable for any reduction in the value of the product resulting from handling other than what is necessary to establish its nature, characteristics and proper functioning.
Article 9 — Legal warranties
All products are covered by the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) for 2 years from delivery, and by the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).
In the event of a lack of conformity, the customer may request the repair or replacement of the product, or failing that a price reduction or termination of the sale, under the conditions provided for by law. Personalized products are also covered by these legal warranties.
Article 10 — Liability
The products are accessories intended for pets; they must be used in accordance with their description and under the supervision of the animal's owner. Kyvano cannot be held liable for damage resulting from improper use of the products, nor for failure to perform its obligations due to an event of force majeure.
Article 11 — Personal data
The processing of customers' personal data is described in the Privacy policy.
Article 12 — Mediation
In accordance with articles L611-1 et seq. of the French Consumer Code, after a written complaint sent to Kyvano has not received a satisfactory response, the customer may refer the matter free of charge to the consumer mediator:

Article 13 — Applicable law
These Terms and Conditions of Sale are governed by French law. In the event of a dispute, and failing an amicable agreement, the French courts shall have jurisdiction, without prejudice to any more protective mandatory provisions from which the consumer may benefit in their country of residence.
